Rohm and Haas wins summary judgment in biocides requirements contract dispute

Client(s) Rohm and Haas Company

Jones Day client Rohm and Haas Company obtained summary judgment in a lawsuit brought in the District Court for the Northern District of Georgia by Arch Chemicals, Inc. and Arch UK Biocides, Ltd. involving a three-year requirements contract for the sale of biocides. Plaintiffs sought damages after Rohm and Haas invoked the contract's early release clause. In granting Rohm and Haas' motion for summary judgment, the court found that Rohm and Haas was entitled to summary judgment on all claims because the contract language's objective purpose, and not the plaintiffs' alleged subjective purpose, controlled.
