Experian obtains Fourth Circuit dismissal of $10 million class action judgment

Jones Day client Experian Information Solutions obtained a Fourth Circuit decision dismissing a $10 million class action judgment against Experian for lack of Article III standing. Plaintiffs alleged Fair Credit Reporting Act claims related to credit card accounts they held with Advanta Bank, which went into receivership in 2010. Plaintiffs claim that Experian willfully violated the FCRA by listing their credit card accounts under the name "Advanta" on their credit files rather than the name of the credit card servicer administering the accounts even though no one was harmed by the choice of name.
