Major university hospital system obtains dismissal of False Claims Act allegations

Jones Day was engaged on behalf of a major university hospital system in connection with a federal and state False Claims Act case alleging violations of the Anti-kickback Statute and the Stark Law. Relator also alleged that the hospital system made false representations to CMS and the state Medicaid program as part of one of its hospital’s participation in the state’s Medicaid Upper Payment Limit reimbursement system and Inter-Governmental Transfers program. Following an investigation, Jones Day made a presentation to the government and the Department of Justice and the State Attorney General declined to intervene. Relator filed a notice of voluntary dismissal.
