Platform compels arbitration in business-to-business putative class action alleging breach of contract and fraud

Jones Day obtained an order compelling arbitration in a business-to-business putative class action lawsuit brought against a services platform by its business partners, alleging the platform improperly breached its contracts and violated the Illinois consumer fraud statute.
On December 9, 2019, after two rounds of briefing and extensive discovery on the arbitration issue, Judge Paul S. Diamond compelled arbitration. The court found that the contracts plaintiffs signed with the platform incorporated the platform's current terms of use, including an arbitration provision. The court granted the defendant's motion to compel arbitration, directed the plaintiffs to arbitrate the case, and stayed the case pending determination of the arbitration proceedings.
