Pro bono client secures remand in 7th Circuit appeal raising Administrative Procedure Act and Constitutional claims

Jones Day, appointed as pro bono counsel by the U.S. Court of Appeals for the Seventh Circuit, represented a prison inmate in his appeal. The district court had dismissed the inmate's Administrative Procedure Act and Constitutional claims against the Bureau of Prisons at the Prison Litigation Reform Act Screening Stage, and issued him a strike.

After Jones Day filed the initial brief arguing that the district court erred in dismissing the case at the screening stage, the government decided not to file a response brief, and the Court agreed that dismissal was improper, vacating the decision and remanding the case back to the district court. In addition to securing a remand, the Firm successfully moved to have the Appellate Court remove the strike from the inmate's record.
