Jones Day advised a pharmaceutical distributor in obtaining a favorable settlement of two qui tam actions under the False Claims Act investigated by the U.S. Attorney's Office for the District of Massachusetts. The actions alleged that the distributor's practice of offering up-front discounts, sometimes known as prebates, violated the federal Anti-Kickback Statute and civil False Claims Act. In addition to the settlement, the Jones Day team negotiated a favorable Corporate Integrity Agreement (CIA) with the Department of Health and Human Services Office of Inspector General (HHS-OIG).
