Luxembourg secures full dismissal of State aid complaint

Jones Day successfully represented the Grand-Duchy of Luxembourg ("Luxembourg") in a European Commission investigation initiated in 2021 following a complaint regarding the compatibility with State aid rules of Luxembourg's Large Scale Testing ("LST"), an ambitious nationwide campaign to monitor and control the spread of COVID-19 through free and voluntary testing.

After a thorough examination, the Commission concluded that Luxembourg's measures to implement the LST did not constitute State aid under Article 107(1) TFEU. The Commission closed its preliminary investigation and issued its decision to fully dismiss the complaint.
