IBM successfully resolves copyright infringement and software licensing dispute

Jones Day successfully represented International Business Machines Corporation (IBM) in a copyright infringement and software breach of license case involving IBM's Informix software. Informix is IBM's flagship software for database management and online transaction processing. BGC had been a long-time IBM customer with a limited license to use Informix at certain defined levels. Jones Day filed suit for IBM in the Southern District of New York alleging BGC over-deployed Informix and refused to pay the necessary licensing fees for the full extent of its usage. Shortly before trial on IBM’s copyright and contract claims, the parties reached a mutually satisfactory resolution.
