WESCO defends claim arising out of construction of high speed military boats for the Norwegian Royal Navy
Client(s) WESCO Distribution, Inc.
Jones Day was retained by WESCO Distribution, Inc. to investigate a $62 million claim for alleged project delays and extra costs related to the construction of six high speed military boats for the Royal Navy of Norway. This claim was made in an Norwegian arbitration by Umoe Mandel ("Umoe") against Pratt & Whitney Marine Systems ("PWMS"). PWMS contracted with Umoe in 2003 to supply the propulsion packages for the military boats. Control Corporation of America ("CCA"), a division of WESCO Distribution, contracted with PWMS to supply the control systems and certain auxiliary systems for the propulsion packages. PWMS notified CCA that it would hold CCA responsible for any damages that PWMS incurred in the arbitration due to alleged deficiencies in CCA's scope of supply.
