Experian resolves putative class action alleging violations of Fair Credit Reporting Act

Jones Day successfully represented Experian Information Solutions, Inc. in a putative class action brought by a consumer in the Eastern District of New York alleging that Experian and other credit reporting agencies generated false credit reports regarding charged-off accounts. The named plaintiff in the lawsuit specifically alleged that Experian and other credit reporting agencies violated the Fair Credit Reporting Act by reporting tradeline account balances exceeding charged-off amounts. The plaintiff sought to certify a class of consumers with allegedly inflated charged-off account balances. Experian defended the robustness of its procedures related to charged-off accounts, and the case resolved. A class was not certified by the Court.
