FirstEnergy defends coal contract dispute with Tunnel Ridge

Jones Day defended FirstEnergy Corp. in a now-resolved and dismissed lawsuit brought by Tunnel Ridge, LLC in the Court of Common Pleas for Allegheny County, Pennsylvania against FirstEnergy Corp. and three of its subsidiaries, alleging breach of a coal supply agreement, among other claims. Tunnel Ridge, a coal supplier, originally sued only the subsidiary that is a signatory to a long-term coal supply agreement with Tunnel Ridge but later amended its complaint to add as defendants FirstEnergy Corp. and two additional subsidiaries, pleading, among other things, alter ego theories of recovery against these new defendants.
