Air Evac obtains affirmation of dismissal of putative class action by Tenth Circuit

Jones Day represents Global Medical Response, Inc. subsidiary Air Evac EMS, Inc. ("Air Evac") against claims filed on behalf of a putative class of consumers in Oklahoma alleging Air Evac charges improper fees for its services. Jones Day filed a motion to dismiss all of the plaintiffs' claims on the basis that they were preempted by the federal Airline Deregulation Act of 1978 ("ADA"). The district court granted the motion in full and dismissed the case. After extensive briefing and following oral argument, the Tenth Circuit affirmed the dismissal of all of the plaintiffs' claims based on preemption under the ADA.
