Mitchell's Bar & Restaurant successfully obtains permanent injunction regulating smoking in a public place

Jones Day represented two local restaurants in a suit seeking temporary and permanent injunctive relief against enforcement of an invalid and preempted county ordinance regulating smoking in public place. At an evidentiary hearing, Jones Day presented multiple witnesses and cross-examined county officials. After an appeal to the Commonwealth Court of Pennsylvania, Jones Day successfully obtained a permanent injunction for the restaurants.
