Eric Nicholson is an experienced litigator who helps clients navigate complex legal matters across a variety of industries, with a focus on consumer protection and health care.
Eric has successfully defended dozens of individual and class actions brought under the Fair Credit Reporting Act (FCRA). Notable recent successes include a precedent-setting Eighth Circuit decision affirming summary judgment for a major consumer reporting agency and a summary judgment victory in a proposed consumer class action in the Seventh Circuit.
Eric has also worked with health care providers in a range of matters, helping to achieve successful resolution of False Claims Act (FCA) allegations; investigations by the Department of Justice (DOJ), Drug Enforcement Administration (DEA), and state officials; and high-profile internal investigations. He currently represents a major hospital system in multiple provider/payor lawsuits seeking full reimbursement for health care services.
Eric has an active pro bono practice. He has represented numerous asylum seekers in proceedings before U.S. Immigration Courts, recently obtaining asylum for a Venezuelan mother and daughter who were persecuted for opposing the autocratic regime in their home country. In addition, Eric is active in criminal justice issues. In 2019, he helped secure release for an individual sentenced to mandatory life without parole as a teenager. He has since worked to obtain similar outcomes under Michigan law for juveniles sentenced to decades-long term-of-years sentences.
