Sutter Health obtains dismissal of unfair pricing case
Client(s) Sutter Health
Sutter Roseville Medical Center and Sutter Health have been represented by Jones Day in a claim of unfair business practices for pricing to accident victims treated at Sutter Roseville's trauma center since 2005. The plaintiff, Michael Stowers, proposed to represent a putative class of "uninsured" accident victims. Plaintiff asserted two causes of action against the company: (i) a claim for interpleader; and (ii) a claim for violation of the California Unfair Competition Act. In May 2010, the Superior Court granted summary judgment in Sutter's favor and entered judgment against the plaintiff.
