Margaret Toohey represents clients in high-stakes, cross-border litigation and arbitration, including class actions and multibillion-dollar claims on both the plaintiff and defense sides. Her practice centers on matters in the mining, manufacturing, construction, health care, and global commodities sectors.
Margaret has significant experience handling force majeure and business interruption claims, including claims stemming from plant accidents, the COVID-19 pandemic, and international sanctions. She has also litigated multiple cases related to climate change, environmental contamination, manufacturing and design defects, and alleged unfair competition practices. In the health care sector, she has represented hospital systems, biotechnology companies, and pharmaceutical distributors in matters ranging from opioid litigation to executive compensation disputes.
An accomplished trial advocate, Margaret has taken more than a dozen matters to final hearings on the merits. Margaret's international arbitration experience spans disputes under the AAA, CPR, ICAC, ICC, ICDR, ICSID, and LCIA rules, applying EU, Brazilian, Kazakh, Italian, Russian, Spanish, and Swiss substantive laws (among others). Her cross-border litigation work includes parallel group litigation across multiple continents and Section 1782 discovery taken in five U.S. circuits for use in the largest trial in English legal history.
A trusted advisor, Margaret regularly counsels clients on navigating global commercial challenges and minimizing the risk of disruptive lawsuits. She also maintains an active pro bono practice, securing asylum for political dissidents.
In the civic arena, Margaret serves on the Junior Board of EDWINS Leadership & Restaurant Institute and is a member of the Cleveland Committee on Foreign Relations.
