Envoy Air defeats class certification in retention bonus dispute

Jones Day obtained an order denying class certification on behalf of Dallas-based Envoy Air Inc., which flies under the American Eagle brand. A former employee brought a putative class claim in Texas state court related to new hire retention bonuses alleging the bonuses constituted an unlawful restraint of trade and seeking to invalidate the bonus agreements on behalf of himself and the punitive class. Jones Day argued on behalf of Envoy that class treatment was inappropriate because individual issues would predominate the litigation. Citing numerous issues of law and fact affecting only individual class members, the court denied class certification.
