Philippe Goutay has represented French and international financial institutions on compliance with banking and financial regulations for more than 20 years. He is an acknowledged leader in securities law, including trading, clearing, custody, and collateral.
Philippe has advised financial institutions within the EU and French regulatory legal framework on application forms filed with French financial supervisory authorities relating to licensing, authorizations, and capital requirements, including for market infrastructures such as market undertakings or clearing houses. His practice also focuses on the marketing of financial products or services, notably on cross-border and anti-money laundering issues. Complementary to this advisory role, he represents and assists clients before enforcement authorities such as the AMF (Autorité des marchés financiers) or the ACPR (Autorité de contrôle prudentiel et de résolution).
Since 2014, Philippe has been a member of the clearing, custody, and securities settlement advisory committee of the AMF. From 2007 to 2009, he was a member of the French delegation for the negotiation of the Geneva Securities Convention on the substantive rules for intermediated securities. Philippe lectures on central securities depositories and clearing houses in the Master 2 program in financial law at the University of Paris-Dauphine and has authored more than 40 publications in the financial regulatory area.
