Daniel W.Berens (Dan)

Dan Berens is an experienced complex commercial litigator who helps clients navigate high-stakes litigation and investigations. He has represented clients across a range of industries in litigation before state and federal courts involving alleged violations of the Controlled Substances Act (CSA) and state consumer protection laws, public nuisance, false advertising, false claims, and veil piercing theories.

Dan's recent experience includes defending a major pharmaceutical manufacturer in investigations brought by state attorneys general related to allegations of price-fixing, market allocation, and consumer deception; and he has continued his representation in related civil litigation. He also recently defended a national retailer in lawsuits brought in jurisdictions across the country alleging that the distribution and sale of prescription opioids constitutes a public nuisance and a violation of various state and federal laws, including cases brought by state attorneys general.

Dan also maintains an active pro bono practice. As part of Jones Day's Border Project, he is serving as lead trial counsel for an individual seeking to obtain political asylum in the United States.

Before joining Jones Day, Dan clerked for Judge L. Scott Coogler of the United States District Court for the Northern District of Alabama.
