Daniella Einik assists clients in developing creative and effective solutions to complex environmental litigation, transactional, and compliance issues. Daniella has successfully assisted industry clients in multimillion dollar civil enforcement and public nuisance actions, Department of Justice (DOJ) criminal investigations, toxic tort litigation, and contractual indemnification disputes, as well as in the pursuit of "takings" and other claims against the United States.
Daniella advises and counsels clients on environmental issues related to bankruptcy, corporate transactions, and compliance with the federal Clean Air Act (CAA), Clean Water Act (CWA), Toxic Substance Control Act (TSCA), Resource Conservation and Recovery Act (RCRA), and Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). Daniella also has experience with corporate criminal investigations as they relate to federal and state environmental, health, and safety laws. Daniella has also developed specific experience in emerging environmental issues, such as PFAS (per- and polyfluorinated substances), and regularly advises clients on regulatory developments and litigation risk associated with these emerging issues.
As a volunteer for the Washington Legal Clinic for the Homeless, Daniella provides legal representation to individuals in the Washington D.C. community seeking social security disability, housing, and shelter benefits. Daniella also served as a member of the board of directors of Friends of the Kenilworth Aquatic Gardens from 2017 to 2023.
Daniella is a member of the American Bar Association's Section of Environment, Energy, and Resources. She serves as a vice chair of the Section's Climate Change and Litigation and Enforcement Committees.
